Cantor Fitzgerald Maintains Overweight on Phathom as Stock Drops 23%
After Phathom Pharmaceuticals announced that BDR Pharmaceuticals filed a suit against the FDA, challenging the agency's refusal to receive an abbreviated new drug application that referenced Phathom's new drug application for Voquezna, Cantor Fitzgerald said the firm appreciates that stocks with ongoing lawsuits can "create overhang situations." While BDR alleges that the FDA has improperly applied the GAIN Act to extend Phathom's exclusivity for Voquezna, the firm sees a low likelihood of the FDA reversing its stance on updating the Orange Book listings and estimates the company "still has 6+ years of selling the therapy without any competition." Cantor keeps an overweight on Phathom shares, which are down 23% to $5.38 in afternoon trading.

Phathom Pharmaceuticals Responds to BDR's Lawsuit Against FDA
Phathom Pharmaceuticals announced that BDR Pharmaceuticals has filed suit against the FDA and related Federal Defendants in the United States District Court for the District of Columbia, principally challenging FDA's alleged refusal to receive an abbreviated new drug application, or ANDA, referencing Phathom's new drug application, or NDA, for Voquezna. In the suit, BDR alleges that FDA has improperly applied the GAIN Act to extend Phathom's New Chemical Entity exclusivity for Voquezna tablets. Phathom is evaluating the BDR filings, but believes that FDA carefully and correctly evaluated this issue in its June 6 grant of Phathom's December 11, 2024 Citizen Petition, in which FDA recognized 10 years of NCE exclusivity for Voquezna tablets through May 3, 2032. Phathom intends to take appropriate action to protect its statutory exclusivities.

Topline results are expected in the first quarter of 2028. If successful, the study is intended to support a potential regulatory submission seeking a label expansion for VOQUEZNA tablets for this treatment regimen.
