Halozyme Wins Patent Case Against Merck
Halozyme Therapeutics (HALO) announced that the specialized Dutch patent court of the Hague has found Merck (MRK) to be infringing one of its MDASE patents, EP 2,797,622 and ordered Merck's central European Market Authorization Holder and worldwide packaging and distribution hub MSD BV to refrain from manufacturing, having manufactured, offering, placing on the market and using, or importing or stocking for these purposes, Keytruda SC in Belgium, Denmark, France, Ireland, Italy, Sweden, Switzerland and the Netherlands. The injunction also forbids MSD to facilitate infringement by its affiliates, including by allowing the use of its European Marketing Authorization. The court also rejected Merck's arguments that EP622 patent is invalid. Importantly, patients who want to use Keytruda will still have access to the IV version of Keytruda, which is not covered by Halozyme's patent or the court's injunction order. Halozyme has also sued Merck for patent infringement in U.S. federal district court in New Jersey. In that case, Halozyme alleges the subcutaneous formulation of Keytruda, which is being marketed in the U.S. as QLEX, infringes 15 patents that Halozyme filed beginning in 2011 to protect its MDASE technology.
Halozyme Expands Collaboration with Argenx to Develop ENHANZE
Halozyme Therapeutics (HALO) announced that it has expanded its global collaboration and license agreement with Argenx (ARGX) to develop and commercialize ENHANZE with two additional exclusive targets. "We are pleased to expand our collaboration with argenx, a recognized leader in immunology, building on the successful development of VYVGART Hytrulo," said Dr. Helen Torley, President and Chief Executive Officer of Halozyme. "The addition of two new exclusive targets further validates the value and versatility of ENHANZE as the leading platform for rapid, large-volume subcutaneous delivery. As more companies seek to focus on patient convenience, reducing treatment burden and expanding access to important therapies, ENHANZE continues to be the technology of choice. This expanded agreement strengthens our growing portfolio of partnered programs and reinforces the significant long-term opportunity for ENHANZE across a broad range of therapeutic areas." "Our partnership with Halozyme shows what co-creation can do for patients," said Arjen Lemmen, Vice President of Corporate Development and Strategy, argenx. "Together, we brought VYVGART Hytrulo to people living with MG and CIDP, which gave patients a subcutaneous option that fits more easily into their lives. Expanding to two more targets lets us bring that same focus on patient experience to more of our pipeline as we build a broader immunology portfolio. We're proud to keep building on a partnership, rooted in shared ambition and scientific rigor." Halozyme is eligible to receive payments upon achievement of agreed upon milestones and will receive royalties on net sales of products using ENHANZE.
Federal Reserve Raises Rates by 25 Basis Points, Stocks Decline
Stocks fell toward their lowest levels since July as the Federal Reserve followed the bond market's strong conviction of a 25 basis point tightening with its first hike in three years, while the Fed's dot plan and unanimous vote suggest the tightening cycle could well extend in months to come and into 2027. The summary of economic projections shows another expected 25bps move before the of the year. Longer-term, post-decision Fed Funds futures activity now sees an odds-on probability of as many as three more hikes by December of 2027. "Price stability is foundational to economic growth," Fed Chair Warsh opined during his press conference, and while President Trump has been vocal for the Fed to lower interest rates, in his post decision comments to the press, he said Warsh could "do what he wants".Industrials was the best-performing sector in the benchmark index by the end of the session, while Energy and Financials were broadly sold.
