Instacart Offers Custom Cakes and Party Platters from Costco for the First Time

Instacart (CART) announced that for the first time, customers can order custom cakes and party platters from Costco (COST) on the Instacart marketplace and sameday.costco.com for delivery from warehouse locations nationwide. The selection includes custom sheet cakes and 10-inch round cakes, along with sandwich platters, shrimp trays, fruit platters, and more. Cakes can be fully customized online and ordered in advance, making it easier than ever to plan for birthdays, celebrations, and gatherings of any size. Costco and Instacart have partnered since 2017, when they launched same-day delivery through the Instacart Marketplace.

Instacart Becomes Exclusive Same-Day Delivery Partner for Petsense

Instacart (CART) and Petsense, a wholly owned subsidiary of Tractor Supply (TSCO), announced a new partnership making Instacart the exclusive same-day delivery partner for Petsense. Starting today, customers can shop Petsense's assortment of pet foods and supplies through the Instacart App and website, with same-day delivery in as fast as an hour with no markups. With over 130 stores nationwide, Petsense joins more than 2,200 national and local retail banners on the Instacart Marketplace.

FTC Seeks Public Comment on Personalized Pricing Policy

The Federal Trade Commission announced it is seeking public comment on an enforcement policy statement regarding personalized pricing, which is the use of personal data to set prices according to the amount that a company believes an individual consumer is willing to spend. "When consumers see a listed price, they expect it to be same price that everyone else sees, not the retailer's estimate of how much they are willing to pay based on their personal data," said FTC Chairman Andrew Ferguson. "The FTC does not have the legal authority to ban personalized pricing in all circumstances, but businesses that fail to tell consumers how their personal data is being used to set a price may be in violation of the FTC Act and other laws we enforce. We are seeking public input on this draft statement, which would put businesses engaged in or considering personalized pricing on notice that the Trump-Vance FTC will not hesitate to enforce the law in this space." The statement goes on to note that the undisclosed collection or use of personal data for the purpose of personalized pricing could violate the FTC Act, which prohibits unfair or deceptive practices in the marketplace.
